Borrowed Event Rentals
Rental Agreement
This contract is between Borrowed Event Rentals (the “Business”) and the customer who signs it at checkout (the “Client”).
Thank you for choosing Borrowed Event Rentals. This agreement explains the terms for reserving, receiving, using, and returning your rental items. Please review the entire agreement carefully before signing.
Terms
Authority to sign
Each party has the authority to enter into this Contract and to perform all of its obligations under this Contract.
Modifications
The Client and the Business must agree to any changes to this contract in writing.
Payment methods
All payments must be made using a payment method approved by Borrowed Event Rentals. Borrowed Event Rentals may require a valid payment card to remain on file until all rented items have been returned and all outstanding charges have been paid.
Rental items and contract documents
“Company” means Borrowed Event Rentals, and “Customer” means the person or organization renting the items. The rented items, quantities, prices, rental dates, pickup times, and additional services are identified in the rental order in this Agreement and in any estimate, invoice, approved change, or other document attached to or referenced by this Agreement. Those documents are incorporated into and form part of this Agreement. If there is a conflict, this Agreement controls unless a later written document signed or approved by both parties clearly states otherwise.
Reservation and payment terms
A reservation is not confirmed until the Customer has signed this Agreement and paid a down payment of 50% of the rental order total, including applicable sales tax. The down payment is non-refundable. The remaining balance is due on the scheduled pickup date: Borrowed Event Rentals will email the Customer a secure link to pay it on that date, and the Customer may also pay it earlier from their account on the Borrowed Event Rentals website. If the pickup date is the day of booking, the full amount is due at booking. Rental items are held for a short time while payment is completed; if payment is not completed, the hold is released and the items become available to other customers. Borrowed Event Rentals may release the reserved items and decline pickup if payment is not received when due.
No security deposit is collected. Amounts owed under this Agreement for late return, extraordinary cleaning, damage, loss, or theft are charged to the payment card on file, as described under Card on File.
Cancellation and rescheduling
Requests to cancel or reschedule must be submitted to Borrowed Event Rentals in writing; a request submitted from the Customer’s account on the Borrowed Event Rentals website is a written request. The down payment is non-refundable. If the request is received at least 14 calendar days before the scheduled pickup date, the Customer may cancel for a refund of all amounts paid other than the down payment, or transfer all amounts paid, including the down payment, to a new available rental date. If the request is received fewer than 14 calendar days before the scheduled pickup date, any refund, credit, or rescheduling accommodation will be provided at the discretion of Borrowed Event Rentals. Rescheduled rentals are subject to item availability and any changes requested by the Customer may affect pricing. If Borrowed Event Rentals cancels the reservation and cannot provide a reasonable substitute or an acceptable new date, the Customer will receive a full refund, including the down payment.
Rental period and return
The rental period begins when the items are picked up by the Customer and ends when all items are returned to and accepted by Borrowed Event Rentals. Each rental lasts 48 hours: the Customer must return the items to the pickup location by the same time of day, two days after pickup, as shown in the rental order. Time is important because the items may be reserved for another customer. Keeping items beyond the agreed return time without written approval may result in additional rental charges based on the then-current rental rate, plus reasonable losses or expenses caused by the delayed return.
Pickup
Borrowed Event Rentals does not deliver or set up rental items; all items are picked up from and returned to the Borrowed Event Rentals pickup location. The Customer or an authorized adult must be available at the pickup time chosen in the rental order unless Borrowed Event Rentals approves another arrangement in advance. Borrowed Event Rentals may charge reasonable additional waiting, rescheduling, or staffing costs if the Customer fails to pick up the items at the agreed time, arrives excessively late, or otherwise causes an unreasonable delay.
Inspection and condition
The Customer must inspect the rental items promptly when they are received. Visible shortages, incorrect items, or existing damage must be reported to Borrowed Event Rentals before the items are used and, whenever reasonably possible, within two hours after pickup. Photographs should accompany the report. Failure to report a visible issue within that period may be considered evidence that the items were received in acceptable condition. This does not apply to a hidden defect that could not reasonably have been discovered during the initial inspection. Hidden defects must be reported immediately after discovery.
Customer care and permitted use
The Customer must use the rental items only for their intended purpose and in accordance with any instructions provided by Borrowed Event Rentals. The Customer may not sell, subrent, loan, alter, paint, cut, permanently mark, or remove identifying labels from any rental item. Nails, staples, glue, permanent tape, open flames, wax, paint, and other potentially damaging materials may not be used on or near rental items without prior written approval. No person may climb, stand, sit, hang from, or place excessive weight on an item unless it was specifically designed for that use. The Customer is responsible for supervising all use of the rental items.
Outdoor use and weather
Rental items may be used outdoors only when appropriate for the item. The Customer is responsible for monitoring weather and protecting items from rain, snow, standing water, excessive moisture, wind, extreme temperatures, smoke, mud, and other damaging conditions. Items must be moved to a secure indoor location when unsafe weather is expected. Borrowed Event Rentals may decline or reschedule a pickup, or ask the Customer to stop using items, when conditions are reasonably considered unsafe. The Customer is responsible for damage resulting from failure to protect the items or follow weather-related instructions.
Risk of loss, damage or theft
The Customer assumes responsibility for the rental items from the time they are picked up by the Customer until they are returned to and accepted by Borrowed Event Rentals. The Customer is responsible for loss, theft, disappearance, destruction, and damage beyond ordinary wear during that period, including damage caused by the Customer, guests, vendors, venue personnel, weather, transportation, or inadequate security. Charges may include reasonable repair costs or, when repair is not practical, the current replacement cost of a substantially similar item, together with applicable tax, shipping, and reasonable loss of rental use during the necessary repair or replacement period. Borrowed Event Rentals will provide an itemized explanation of additional charges.
Late or unreturned items
Items not returned by the agreed deadline are considered late. The Customer is responsible for additional rental charges based on the then-current rental rate for each additional rental period, along with reasonable recovery, replacement-rental, and customer-notification expenses resulting from the delay. An item that has not been returned after written demand may be treated as lost, and the Customer may be charged its reasonable replacement cost. If a late item is returned after replacement charges have been collected, Borrowed Event Rentals will determine an appropriate credit after deducting late charges, recovery expenses, and any damage.
Card on file
The Customer agrees to maintain a valid payment card on file until all rented items have been returned and all amounts due under this Agreement have been paid; the card used at checkout is saved securely with Borrowed Event Rentals’ payment processor for this purpose. Subject to the Customer’s payment-card authorization at checkout, Borrowed Event Rentals may charge that card for unpaid rental balances and documented amounts due for approved changes, late returns, extraordinary cleaning, damage, loss, theft, replacement, recovery expenses, and other charges authorized by this Agreement. Borrowed Event Rentals will provide an itemized receipt or notice of additional charges. The Customer must promptly notify Borrowed Event Rentals of any believed billing error.
Item availability and substitutions
Borrowed Event Rentals will make reasonable efforts to provide the items listed in the rental order. If an item becomes unavailable because of prior damage, loss, delayed return, transportation problems, or another circumstance outside Borrowed Event Rentals’ reasonable control, Borrowed Event Rentals may offer a reasonably comparable substitute. The Customer may accept the substitute or receive a refund of the amount charged for the unavailable item. Borrowed Event Rentals will not make a materially different substitution without notifying the Customer.
Liability and third-party claims
The Customer is responsible for injuries, property damage, and third-party claims caused by the Customer’s or another person’s misuse, unauthorized modification, improper setup, inadequate supervision, or failure to follow instructions concerning the rental items. To the extent permitted by law, the Customer will reimburse and protect Borrowed Event Rentals from reasonable third-party claims, damages, and expenses caused by those acts or omissions. This provision does not require the Customer to assume responsibility for Borrowed Event Rentals’ fraud, willful misconduct, violation of law, or any responsibility that cannot lawfully be transferred.
Entire agreement and severability
This Agreement, together with its attached or referenced estimate, invoice, rental order, approved change, and payment-card authorization, contains the complete agreement between Borrowed Event Rentals and the Customer concerning the rental. It replaces prior oral or written discussions concerning the same rental. If any provision is found unenforceable, that provision will be enforced to the maximum extent permitted or removed, and the remaining provisions will continue in effect.
Electronic communications and signatures
The Customer agrees that this transaction may be conducted electronically and that contracts, notices, invoices, receipts, approvals, and signatures may be provided and retained electronically. An electronic signature is intended to have the same effect as a handwritten signature. The Customer should download or retain a copy of the completed Agreement for the Customer’s records; a copy is also kept with the booking in the Customer’s account.
